Rental Terms & Conditions

Equipment Condition and Return The undersigned Lessee acknowledges that they have examined and inspected the rented equipment and found it to be in good working condition. The Lessee agrees to return the equipment to Dive Rinse Repeat Scuba, LLC in the same condition in which it was received, excluding ordinary wear and tear. Equipment should be returned clean and free of excessive dirt, sand, salt, or other contaminants. Dive Rinse Repeat Scuba, LLC reserves the right to assess reasonable cleaning and restoration fees if equipment is returned in an excessively dirty condition. Equipment not returned by the agreed-upon return date may continue to accrue rental charges at the applicable rental rate until the equipment is returned or, if not returned, replaced. If the equipment is lost, stolen, damaged, or destroyed while in the Lessee's possession, the Lessee agrees to pay the reasonable cost of repair or, if the equipment cannot be repaired, the current replacement cost of the equipment.

Proper Use of Equipment The Lessee certifies that they have received appropriate instruction in the proper use of the rented equipment and are qualified to use it safely, or that the equipment will be used only under the direct supervision of a qualified scuba professional. The Lessee assumes full responsibility for the proper use of the equipment and agrees to hold Dive Rinse Repeat Scuba, LLC harmless from any claims, damages, injuries, or losses arising from its use or misuse. The Lessee agrees to discontinue use of any rented equipment that appears to be malfunctioning or damaged and to notify Dive Rinse Repeat Scuba, LLC as soon as reasonably possible. The Lessee shall not attempt to repair, modify, or disassemble any rented equipment. If a dive computer is included in the rental equipment, the Lessee acknowledges that they are responsible for understanding its operation and for diving within the limits and recommendations provided by the manufacturer and their training. If scuba cylinders are rented, the Lessee agrees that they will be filled only by an authorized fill station, will not be altered or modified in any way, and will not be used beyond their current visual inspection or hydrostatic test dates.

Responsibility for Equipment and Use The Lessee accepts full responsibility for any injury to themselves or others, and for any damage to property, arising from the use or misuse of the rented equipment from the time it leaves the possession of Dive Rinse Repeat Scuba, LLC until it has been returned. The Lessee further agrees that the equipment shall not be loaned, rented, transferred, or otherwise used by any person other than the Lessee without the prior written consent of Dive Rinse Repeat Scuba, LLC.

Security Interest and Default The Lessee agrees to keep the rented equipment free from any liens, encumbrances, or claims by third parties. In the event of default under this agreement, or if the equipment is not returned as agreed, Dive Rinse Repeat Scuba, LLC reserves the right to immediately recover possession of the equipment wherever it may be located, provided such recovery is lawful. Such recovery shall not relieve the Lessee of any obligations or liabilities under this agreement.

Acknowledgement and Legal Costs The Lessee acknowledges that they have read, understood, and voluntarily agree to all terms and conditions of this Rental Agreement. The Lessee further acknowledges that this Rental Agreement is separate from, and does not replace or modify, any liability release, assumption of risk agreement, or other waiver that may be required for scuba training, diving activities, or equipment use. Should legal action become necessary to enforce this agreement, the prevailing party shall be entitled to recover reasonable attorney's fees, court costs, and other expenses as permitted by applicable law.
